Ligaya, who is Arnel’s mother, confirmed when giving her testimony in court that Arnel has suffered abuse. Oscar’s explosive nature was targeted towards her and the children. It is no secret that the atmosphere at home was horrible, and unless one wanted to be uncomfortable all the time, they had to live in fear, which deeply affected Arnel. He had a rough childhood but managed to complete his education while living the life of an ordinary teenage boy. Of course, all that abuse took a toll on him and mattered in the long run.
Arnel was only 17 on February 19, 1986, when he committed his life-changing crime. Arnel shot and killed Oscar Salvatierra in a violent rage. The abuse, coupled with his fear of his father, was strong enough to make the child lose it. He later stated trying to reason with the violence wasn’t an option and, on the off chance he did not kill Oscar himself, Oscar would kill him or any other family member.
The family home, which is located in Glendale, California, is where the shooting occurred. In an act of desperation, Arnel made the impulsive decision to use a gun that was in the house. The entire family was devastated by the event’s aftermath. The death of Oscar certainly left a gap, but it also exposed the very grim details of home life that Arnel and his siblings were trying to cope with.
Arnel Salvatierra’s legal case was front-page news largely because of the nature of the crime and the surrounding context. Arnel was initially accused of first-degree murder, which carries a heavy penalty. His legal counsel, unimpressive though they were, included the well-known lawyer Leslie Abramson.
She pursued a strategy of more reasonable murder charges due to shifts in the context. In her view, the circumstances Arnel had to face at the age gave her more than enough ammo to work with.
Leslie Abramson, a professional with years of experience in high-profile criminal cases, began her defense for Arnel by asserting that he was a victim of self-inflicted domestic violence. Abramson believed that years of emotional and physical abuse would make anyone act in a survivor’s self-defensive manner, not a murderous one.
Specialized witnesses were also brought in by the defense to explain the psychological impact of living in an abusive environment. The case of Arnel Salvatierra was tried before a jury in 1988. Their decision was that he was guilty of voluntary manslaughter, which is less severe than first-degree murder. This verdict led to a sentence of three years of probation and psychotherapy.
This probationary period is substantially lower in manslaughter, which one would normally expect to receive for a guilty first degree murder verdict, and thus saw it as an appropriate balance between justice and the circumstances of the case.
